Brian Rivera Charged with Murder in Fatal Lynn Shooting

LYNN, Mass. – April 11, 2025 – Two men were arrested and arraigned today in Lynn District Court following a fatal shooting that occurred in the area of 33 High Street in Lynn late Thursday night, Essex County District Attorney Paul F. Tucker confirms. Police received a call of shots fired at approximately 11:23 p.m. last night and found Derek Hines, 35, of Lynn, unresponsive with apparent gunshot wounds. Hines was treated on scene and transported to Salem Hospital, where he was later pronounced deceased.

In Lynn District Court this afternoon, Brian Rivera, 36, was arraigned on charges of murder, carrying a firearm without a license, discharging a weapon within 500 feet of a building, possessing ammunition without a firearm identification card, possessing a Class B drug, possessing a Class C drug, possessing a Class E drug, and a firearm violation with three prior violent/drug crimes.

Michael Constabile, 35, was also arraigned on charges of being an accessory after the fact as well as a municipal knife ordinance violation. Both defendants pled not guilty. The Hon. Kareem A. Morgan ordered Rivera to be held without bail. Constabile was held on $100,000 cash bail.

Assistant District Attorney Stefanie Stanbro handled the arraignment on behalf of the Commonwealth. Rivera was represented by attorney Murat Erkan, while Constabile was represented by attorney Stephen Francis Reardon. Rivera is due to return to court for a probable cause hearing on May 9 at noon. Constabile is slated to return to court for a probable cause hearing on April 18 at noon.

All suspects and defendants are presumed innocent until proven guilty.
